ESTATE PLANNING AND PROBATE
I represent clients who are probating or administering an estate, which involves the gathering of a decedent’s assets at death, settling any outstanding debts, and distributing the net assets according to either the terms of the will (probate) or the intestacy laws of New York State (administration). Doing so should take into account the use of wills, tax and property laws, insurance and trusts so as to retain the maximum amount possible to pass along to your heirs and distributees according to one’s final wishes.
Probate is the court process through which a will is proved to be valid and then used to distribute the decedent’s estate. In the absence of a will, the process is called an administration proceeding.
TAX ISSUES
I represent individuals and commercial clients in matters with tax implications. These matters usually entail identifying and addressing federal and state tax issues, and then structuring transactions in such a way as to minimize taxes and avoid inherent tax problems.
